  1. Scope of personal data processed:

Upon subscription to the newsletter by the Data Subject, among the personal data of the Data Subject, the Data Controller shall process his/her surname, first name and e-mail address.

  1. The legal basis of data processing:

    1. Voluntary consent of the Data Subject pursuant to point a) of Article 6 (1) of Regulation (EU) 2016/679 of the European Parliament and of the Council (General Data Protection Regulation).

    2. Consent to the data processing relating to the sending of newsletters shall be given by the Data Subject upon subscription to the newsletter by voluntarily providing the information referred to above and voluntarily ticking the statement of consent.

  2. The purpose of data processing:

    1. The purpose of data processing is to send invitations, newsletters and notifications relating to the Data Controller’s own information, programmes and products to the e-mail address provided; the personal data specified above, provided voluntarily by the Data Subject, shall be used exclusively for the purpose of sending newsletters and invitations.

    2. The Data Controller shall not use and it may not use the personal data provided for purposes other than those described in these sections. The disclosure of personal data to third parties shall only be possible with the prior express consent of the Data Subject, unless otherwise provided with binding force by the law, having regard to the provisions of section VI, to which data transfer the Data Subject gives his/her explicit consent when subscribing to the newsletter.

    1. The Data Controller shall not verify the personal data provided by the Data Subject. The person who provided the data shall be solely responsible for the accuracy of the information provided. Simultaneously with providing his/her e-mail address, the Data Subject shall also assume responsibility for ensuring that it is only him/her who uses services from the e-mail address provided. In view of this responsibility, the Data Subject shall be solely responsible for any login from the e-mail address provided.

  1. Duration of data processing:

Data processing begins with the Data Subject’s subscription on the website of Tickless products and the voluntary and direct provision of the required personal data by the Data Subject. The Data Subject’s personal data specified above shall only be processed by the Data Controller during the period of subscription to the newsletter. Should the Data Subject unsubscribe from the newsletter, the personal data processed in connection therewith will be automatically deleted by the Data Controller within 5 business days.

  1. The method of data processing:

The newsletter is sent from abroad via the “Mailchimp” international newsletter system; therefore, the explicit consent of the Data Subject to the transfer of his/her personal data to a foreign data controller is required for registration and use of the service. The Mailchimp system is operated by The Rocket Science Group, LLC (675 Ponce de Leon Avenue, Suite 5000, Atlanta, GA 30308 USA). Data processing in accordance with European Union regulations is provided by the foreign operator on the basis of the provisions of the “EU-U.S. Privacy Shield Framework” data exchange agreement.

  1. Rights and remedies of the Data Subject

The Data Subject has the right to:

  • to request from the Data Controller access to, rectification and erasure of the personal data relating to him/her, and the restriction of the processing of such data, and to object to the processing of his/her personal data;

  • to receive the personal data relating to him/her, previously provided by him/her, in a machine-readable format (pdf, doc, excel, txt) in order to transfer such data to another controller.

  • to withdraw his/her consent to the processing at any time, without prejudice to the lawfulness of the processing carried out prior to the withdrawal. Upon the withdrawal of the consent by the Data Subject and the erasure of the personal data, the Data Controller shall terminate the newsletter service.

If the rights of the Data Subject are breached, he/she may apply to the Court against the Data Controller or request the assistance of the National Authority for Data Protection and Freedom of Information. Remedies and complaints can be lodged with the National Authority for Data Protection and Freedom of Information:

4. Other provisions

  1. The Data Controller reserves the right to amend this Data Protection Notice at any time, subject to the obligation to notify Data Subjects in writing.

  2. In all cases where the Data Controller intends to use the provided data for a purpose other than the purpose of the original data collection, the Data Controller will inform you of this fact and obtain your prior express consent, or provides you with the possibility to prohibit the use in question.

The Data Controller undertakes to ensure the security of the data and to take the technical measures to ensure that the data recorded, stored or processed are protected, and to do everything possible to prevent their destruction, unauthorised use and unauthorised modification. It also commits to call on any third party to whom the data may be transmitted or transferred to fulfill its obligations in this regard. This Data Processing Notice is based on Act CXII of 2011 on the right to information self-determination and freedom of information (hereinafter: Info Act) and the provisions of Regulation 2016/679 of the European Parliament and of the Council (“GDPR”).
