Contents of the warranty:
ProtectOne Ltd. (registered office: H-1021 Budapest, Völgy u. 5/A.; company registration number: 01-09-944010; tax number: 22797933-2-41; e-mail: email@example.com), as the manufacturer and warranty holder, voluntarily warrants the TICKLESS and MITELESS products (hereinafter referred to as “Product“) for a period of 6 months from the date of purchase.
This warranty statement applies only to Products purchased by the consumer as of 1st January 2022 in Hungary as well as on the website www.tickless.com (hereinafter referred to as the “Webshop“), which warranty does not affect the consumer’s rights by provisions of other laws, in particular the right to claim for warranty of accessories. In the event of defective performance concerning the Product, the consumer shall be entitled to exercise his rights of accessory warranty free of charge.
Term of guarantee:
The warranty period begins when the new Product is delivered to the consumer or when the Product ordered is received. In the case of a repair of the Product, the guarantee period is extended by the time during which the consumer could not use the Product as intended because of the defect. In the case of replacement (repair) of the Product or a part of the Product, the period of validity of the warranty claim shall start again for the replaced (repaired) Product (or part of the Product) and for the defect resulting from the repair.
Exercise of the warranty claim, conditions:
The warranty claim under this warranty statement may only be exercised if the purchase price of the Product has been paid in accordance with the agreed payment terms. In order to exercise the warranty claim, the consumer must lodge a complaint with ProtectOne Ltd. within the warranty period, which is 2 months from the date on which the consumer discovered (or should have discovered) the defect.
Upon receipt of the complaint, ProtectOne Ltd. shall record the type and quantity of the Product covered by the warranty claim, the consumer’s details (name, address, telephone number, other details if necessary) and the date of the complaint, and shall issue a written document, which does not constitute an acknowledgement by ProtectOne Ltd. of the thoroughness of the warranty claim.
After examining the complaint and acknowledging the merits of the warranty claim, ProtectOne Ltd. shall decide, at its own discretion – depending on the nature of the defect – whether to repair the Product, to supply a replacement product or, if this is impossible or would result in disproportionate additional costs, to refund the consumer all or part of the purchase price, the amount of which shall be evidenced by the consumer’s invoice regarding the purchase of the Product. The consumer must make the Product available to the producer in order to have it repaired or replaced.
The warranty applies to defects in the construction or material of the Product and to defects arising at the time of delivery of the Product organized by the manufacturer. The warranty may be invoked if a defect has been established on the basis of the technical knowledge available at the time of manufacture. In addition, the cause of the defect must have existed at the time of the said defect.
ProtectOne Ltd. shall be exempted from its warranty obligation if it proves that the cause of the defect arose after the Product was delivered to the consumer. It is also exempted from the warranty obligation if the possible defects, malfunctions or damages are caused directly or indirectly:
- improper use or handling;
- resulting from modifications made to the product by consumer or by third party other than manufacturer.
The warranty for accessories and products are governed by Act V of 2013 on the Hungarian Civil Code, and Government Decree 151/2003 (IX. 22.) on the mandatory warranty for certain consumer durables, as well as Government Decree 373/2021 (VI. 30.) on the detailed rules of contracts between consumers and businesses for the sale of goods, the supply of digital content and the provision of digital services.
